Introduction to the Terms of Use Agreement:

Pioneers Store welcomes you and informs you that below you will find the terms and conditions regulating your use of this store and all the legal implications resulting from your use of the store’s services via the internet through this electronic platform. Any person’s use of the store, whether as a consumer of products or services or otherwise, constitutes their agreement and acceptance of all the provisions of this agreement, and an acknowledgment of their legitimate, legal and regulatory capacity to comply with it.

Article 1 - Introduction and Definitions:

The above preamble is an integral part of this agreement. Below you will find the meanings and definitions of the key terms used in this agreement:

1- (The Store) This definition includes all forms of online stores, whether it is an electronic application, a website, or a physical store.

2- (Consumer) The person who engages in e-commerce with the desire to obtain the products or services provided by the store through its electronic platform.

3- (The Agreement) This term refers to the terms and conditions of this Agreement, which govern and regulate the relationship between the parties to this Agreement.

Article Two - Consumer Legal Capacity:

1- The consumer acknowledges that he has the legal capacity, according to Sharia and the law, to deal with the store, or that his age is not less than eighteen years.

2- The consumer agrees that if he violates this article, he shall bear the consequences of this violation before third parties.

Article Three - Nature of the Store's Obligation:

1- The store’s obligation towards the consumer or consumers is to provide (services or products).

2- The store may provide other services such as after-sales services or other related services, depending on the nature and type of (service or product) required by the consumer.

Article Four - Store Usage Guidelines:

1- The consumer is obligated to use the store’s electronic platform in accordance with public morals and the regulations in force in the Kingdom of Saudi Arabia.

2- When purchasing a service or product from this store, the consumer undertakes not to use this service or product in a manner that violates public morals and the regulations in force in the Kingdom of Saudi Arabia.

Article Five - Accounts and Registration Obligations:

By applying for membership in this store as a user, you agree to disclose specific information and choose a username and password to use when accessing the store's services. By doing so, you agree to the following:

1- You are responsible for maintaining the confidentiality of your account information and password, and you agree to immediately inform this store of any unauthorized use of your account information with the store or any other breach of your confidential information.

2- The store shall in no way be liable for any loss that may be incurred by you, directly or indirectly, morally or materially, as a result of disclosing the consumer’s name or password information.

3- You commit to using your account or membership with the store yourself, as you are fully responsible for it. If someone else uses it, this is evidence that you have authorized them to use the store in your name and on your account.

4- You agree to use the store seriously and honestly.

5- You agree to disclose true, correct, up-to-date, complete and legal information about yourself as required during registration with the store and you agree to update your data if it changes in reality or if the need arises.

6- Our store is committed to handling your personal information and contact details with complete confidentiality.

7- If it becomes clear to the store that you have disclosed information that is untrue, incorrect, outdated, incomplete, illegal, or contrary to what is stated in the User Agreement, the store has the right to suspend, freeze, or cancel your membership or account on the platform, without prejudice to the store’s other rights and legitimate means of recovering its rights and protecting other consumers.

8- In the event of non-compliance with any of the above, the store management has the right to suspend or cancel your account or membership or block you from using the store's services again.

Article Six - Electronic Communications, Privacy and Data Protection:

First: Electronic communications

1- The parties to this agreement agree that communication will be via email, mobile number, or any other means of communication registered with the store.

2- The consumer agrees that all agreements, notices, advertisements, statements and electronic communications sent by the store shall be considered equivalent to written correspondence and shall have the same legal effects.

3- The consumer agrees to be contacted to notify him of the status of orders, offers, or any updates or notices relating to the store or this agreement.

Second: Protecting personal data and privacy

1- The store is committed to maintaining the privacy of the consumer’s personal data and processing it in accordance with the regulations in force in the Kingdom of Saudi Arabia.

2- The store may collect the data necessary to complete registration, fulfill orders, provide after-sales services, or improve the user experience, including - but not limited to - name, mobile number, email address, address, and order data.

3- The store may share the necessary data with payment service providers, shipping companies, relevant government agencies, or any other entities that need to be dealt with to fulfill the order or to comply with regulations, only to the extent necessary.

4- The store is committed to taking appropriate measures to protect personal data from unauthorized access, use or disclosure, in accordance with technical capabilities and applicable regulations.

The store does not sell, rent, or commercially exploit personal data for the benefit of any third party.

5- The store may use cookies or similar technologies to improve site performance, analyze its usage, and develop the user experience.

The consumer has the right to request an update or correction of his personal data in accordance with the applicable regulations.

6- The store retains the data for the period required by the regulations or required for the purposes of providing the service, and then disposes of it or hides its identity whenever possible.

7- By using the store, the consumer agrees to the collection, use and processing of his personal data in accordance with the provisions of this agreement and the regulations in force in the Kingdom of Saudi Arabia.

Article Seven - Amendments to the User Agreement and Fees:

1- If any article or clause in this agreement is cancelled or becomes invalid, such cancellation or invalidation shall not affect the validity of the remaining articles, clauses, rules, and provisions of this agreement, which shall remain in full force and effect until further notice from the store management.

2- This agreement - which is amended from time to time as required - constitutes the mechanism for working, understanding and agreement between (the consumer) and (the store).

3- The store may charge some consumers fees depending on the offers, products or services they request, or on the fees or taxes imposed by the state on the nature of the product or service.

4- The store reserves the right to add, increase, decrease or deduct any fees or expenses in accordance with the terms and conditions of the User Agreement, from any consumer, regardless of the reason for their registration.

Article Eight – Payment and Settlement Services:

1- The store provides approved electronic payment methods through payment service providers available on the platform, and any payment method may be added or cancelled at any time.

2- The store issues an electronic invoice to the customer in accordance with the regulations in force in the Kingdom of Saudi Arabia.

3- The customer is obligated to use a legitimate payment method that belongs to him or that he is authorized to use legally.

Article Nine – Intellectual Property:

1- The intellectual property rights of the store are fully owned by the store, whether they were owned by them before or after the establishment of this electronic platform.

2- The consumer or consumers respect the intellectual property rights of the store, which include the store’s name itself, and other words, logos and symbols belonging to or displayed on the store, as every right that follows the store’s name is fully intellectual property owned by the store.

3- It is prohibited to copy, reuse or publish any part of the store’s content, images, logos or product descriptions without prior written consent from the store.

Article Ten - Store Responsibility:

1- The store undertakes to conduct its business through this electronic platform in a regular manner and in accordance with the regulations in force in the Kingdom of Saudi Arabia, and in accordance with the provisions of this agreement.

2- The store shall not be liable for any delay, loss, or damage arising from causes beyond its control, or from the actions of the consumer or any third party, including shipping companies or payment service providers, or due to natural disasters, governmental decisions, service interruptions, technical malfunctions, or events that render the fulfillment of obligations impossible. This is without prejudice to the rights stipulated by the applicable regulations in the Kingdom of Saudi Arabia.

3- (Al-Rawad Store), its employees, owners, and those who represent them are committed to ensuring that the (product or service) is sound, legitimate, and authorized in accordance with the laws and regulations of the Kingdom of Saudi Arabia, and that its sale is limited to legitimate purposes in accordance with the regulations in force in the Kingdom of Saudi Arabia.

4- The store strives to provide accurate and up-to-date information about products and services, including prices, product availability, specifications, images, descriptions, technical specifications, delivery dates, and other relevant information. However, errors, omissions, or unintentional discrepancies may occur due to human or technical errors, or updates from suppliers or manufacturers. The store reserves the right to correct any error related to prices, stock, product availability, images, descriptions, specifications, or other information, whether before or after order confirmation and even before product delivery. The store also reserves the right to refuse or cancel any order resulting from a clear or material error, refunding any payment made, without any obligation to provide compensation.

Article Eleven - Restriction of Access or Membership:

The store may suspend or cancel the membership of any user in the event of a violation of the Terms of Use or applicable regulations, or in the event of misuse of the platform or suspicion of illegal activity, while the store reserves the right to take the necessary regulatory measures.

Article Twelve - Applicable Law or Regulation:

This User Agreement is governed by and construed in accordance with the laws, regulations and legislation in force in the Kingdom of Saudi Arabia, and is subject in full and completely to the regulations in force with the authorities in the Kingdom of Saudi Arabia.

Article Thirteen - General Provisions:

If any article or clause in this User Agreement is cancelled or becomes invalid, such cancellation or invalidity shall not affect the validity of the remaining articles, clauses, and terms of this User Agreement, which shall remain in effect until further notice from the store management.

This User Agreement - which may be amended from time to time as necessary - constitutes the User Agreement, operating mechanism, understanding, agreement, and contract between the store and the consumer. Both parties to this agreement agree that the following shall be taken into consideration:

1- Arabic is the language to be used when interpreting the provisions of this agreement, or when translating it into another language.

2- The store reserves the right to amend prices at any time before the order moves to the execution or shipping stage or is in the (pending) status. This does not affect confirmed orders or orders that are in execution or shipping status, unless there is a clear error in the price according to Article Ten.

3- The promotional or marketing offers that the store may put forward are temporary offers, as the store has the right to modify or stop these promotional or marketing offers at any time.

4- Receiving the order, issuing the order number, or the order being under review does not constitute final acceptance of it. The sale is not concluded until the order is confirmed by the store and prepared for shipment, and this does not entail an obligation to complete the sale before this confirmation.

5- All prices include VAT where applicable, unless otherwise stated.

6- The parties to this agreement are committed to dealing with each other in a manner that does not violate the Sharia rules, regulations and laws in force related to the nature of the transaction between the store and the consumer.

7- The store may amend, update or terminate this agreement in accordance with applicable regulations, with the updated version being published on the platform. Continued use of the store constitutes acceptance of the amendments.

8- Product images are for illustrative purposes only. Some details, colors, or accessories may differ from the actual product according to updates from the manufacturer or supplier.

9- The technical specifications are based on data received from the manufacturer, and the store reserves the right to update them whenever any modifications are received from the factory or supplier.

10- The consumer may not assign his rights or obligations arising from this agreement to any other party without the written consent of the store.

11- The announced shipping period begins from the date of order confirmation and commencement of its execution, and may vary according to the city, shipping company, or circumstances beyond the control of the store.
